Protection of personal data for the purpose of EXIsport marketing

Information on the protection and processing of personal data processed for the purpose of EXIsport marketing ( in connection with the modification from 04/2019)

The company PPG Group s.r.o. with registered office Opatovská cesta 14, 040 01 Košice, Slovak Republic, ID No. 51 887 819, registered in the Commercial Register of the District Court of Košice I, section Sro, insert no. 46297/V (hereinafter referred to as the "Company"), which since April 2019 has been the operator of retail stores and an e-shop under the name EXIsport (hereinafter referred to as the "EXIsport network") .

In connection with the above, the Company also became the operator of the Loyalty Program of the EXIsport network (hereinafter referred to as the "Loyalty Program").

The original operator of the EXIsport network was the company TOMIREX s.r.o., with its registered office at Opatovská cesta 14, 040 01 Košice, IČO 31 723 420, registered in the Commercial Register of the District Court of Košice I, section Sro, insert no. 7510/V (hereinafter also "Original operator").

In connection with the mentioned facts, the Company, as the current operator, is in accordance with the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons in the processing of personal data and on the free movement of such data (further on as appropriate the "Regulation"), in particular according to Art. 14 of the Regulations, the information provided below is provided with the understanding that the protection of personal data is also covered by Act no. 18/2018 Coll. on the protection of personal data.

The Company as an operator processes personal data for the purposes of sending newsletters and marketing and on the legal basis of the consent of the person concerned pursuant to the Regulation or the legitimate interest of the Company as the operator of the EXIsport network, as described below. If personal data were not obtained from the person concerned, or of its representative, were provided to us from the source of the Original Operator.

The processed personal data for the purposes of sending newsletters and marketing are e-mail address and, if applicable, first and last name.

In the case of consent to the processing of personal data, this is granted according to the Regulation . In this case, the legal basis for processing personal data is consent in accordance with the Regulation and legal regulations for the protection of personal data. This consent can be revoked at any time using the procedure below.

If the processing of existing personal data of the person concerned (especially as an existing customer of the EXIsport network or a member of the Loyalty Program of the EXIsport network or a subscriber of the EXIsport network newsletter) is not based on the consent of the person concerned, the processing of personal data can be carried out for the stated purpose even without the consent of the person concerned on a legal basis legitimate interest of the operator to continue to maintain communication with this person to the extent necessary and to inform him about new offers or benefits in the EXIsport network. Even in this case, information is provided in accordance with the Regulation and the data subject always retains the rights listed below, in particular the right to object to the processing of personal data, using the procedure listed below.  

Personal data must be provided, because without it it is not possible to send newsletters and provide marketing information to the data subject. We will use personal data to the necessary extent given the purpose for which they will be processed. Provision of personal data for marketing purposes is a contractual requirement, unless otherwise stated directly in the Regulation.

Personal data may be provided to persons and recipients who participate in the preparation and sending of these notifications and the fulfillment of the stated purpose of personal data processing. Such persons are mainly contractual partners of the Company from the field of information technology, design and marketing, who participate in the preparation, sending and evaluation of these newsletters and marketing announcements.

Personal data will be stored and consent is granted for a period of 5 years, unless legal regulations for some personal data require a different storage period. Common and not special categories of personal data are processed.

As the operator of personal data processing for the stated purpose and the current operator of the EXIsport network, we present our identification and contact details:

Our valid contact details can be found at www.exisport.com in the Personal Data Protection section, as well as the contact details for any person responsible for personal data protection.

According to the Regulation, you (the person concerned) have the right to:

a)    revoke the consent granted at any time without affecting the legality of the processing based on the consent granted before its revocation; 

b)    request from the Company access to personal data concerning the person concerned and for their correction or deletion or restriction of processing,

c)    to object to the processing of personal data,

d)    on the portability of personal data,

e)    be informed about the source from which the personal data come, or information about whether they come from publicly accessible sources, if the personal data were not obtained from you,

f)     submit complaint to the supervisory authority at the Office for the Protection of Personal Data based in Bratislava.

These rights correspond to our obligations. Each of your authorizations according to letter a) to f) can be applied by sending a request to the Company's headquarters, by sending an e-mail to the address obseneudaje@ppggroup.eu , by delivering the request to any of the EXIsport stores, depending on which of these forms is the most accessible to you. Your request should indicate which of these rights and how you want to use them. 

We are obliged to provide you with information about a different purpose and other relevant information according to the mentioned legal regulations , if we intend to further process personal data for a purpose other than the one for which they were obtained . If that is the intention, we will inform you about it.  We do not perform automated individual decision-making or profiling according to the Regulation and the aforementioned law, we will notify you of any changes.

For sending newsletters and marketing announcements to new interested parties after 04/2019, this person's consent to the provision and processing of personal data is required. From this date, personal data for sending newsletters and marketing announcements to these persons or for reporting changes in data are provided and filled in mainly at www.exisport.com or by filling in the relevant EXIsport Registration Form, which can be found at www.exisport.com or at any store of the EXIsport network, or in another form published by us (depending on availability). The personal data provided must be true, up-to-date, and you must notify us of any changes. In connection with the offer of information society services, we can introduce measures to verify whether the consent of the person concerned, who is under 16 years old, is provided or approved by his legal representative, or proceed according to legal regulations. By providing personal data, signing and expressing consent in the part of the granted consent to the processing of personal data for the stated purpose for new interested parties in sending newsletters from the specified date, the Company as the operator of the EXIsport network is granted consent to the processing of personal data in accordance with these conditions.
