Protection of personal data for the purpose of operating the EXIsport Loyalty Program

Information from the operator on the protection and processing of personal data for the purpose of operating the EXIsport Loyalty Program (in connection with the modification from 04/2019 )

The company PPG Group s.r.o. with registered office Opatovská cesta 14, 040 01 Košice, Slovak Republic, ID No. 51 887 819, registered in the Commercial Register of the District Court of Košice I, section Sro, insert no. 46297/V (hereinafter referred to as the "Company"), which since April 2019 has been the operator of retail stores and an e-shop under the name EXIsport (hereinafter referred to as the "EXIsport network") .

In connection with the above, the Company also became the operator of the Loyalty Program of the EXIsport network (hereinafter referred to as the "Loyalty Program").

The original operator of the EXIsport network was the company TOMIREX s.r.o., with its registered office at Opatovská cesta 14, 040 01 Košice, IČO 31 723 420, registered in the Commercial Register of the District Court of Košice I, section Sro, insert no. 7510/V (hereinafter also "Original operator").

In connection with the above facts, the Company, as the current operator, is in accordance with the Regulation of the European Parliament and the Council (EU) 2016/679 of 27.4.2016 on the protection of natural persons in the processing of personal data and on the free movement of such data (further on, appropriately, the "Regulation "), especially according to Art. 14 of the Regulations, the information provided below is provided with the understanding that the protection of personal data is also covered by Act no. 18/2018 Coll. on the protection of personal data and the amendment of some laws.

Company  as an operator processes personal data for the purpose of operating the Loyalty Program , based on the consent of the person concerned in accordance with the Regulation. In this case, the legal basis for the processing of personal data is the consent granted in accordance with the Regulation and legal regulations on the protection of personal data. This consent can be revoked at any time using the procedure below. Personal data not obtained from the person concerned, or of its representative, were provided to us from a source that is the Original Operator. When agreeing to the processing of personal data, this is granted in accordance with the Regulation.

The provision of personal data for this purpose is a contractual requirement, unless otherwise stated directly in the Regulation. Personal data must be provided, because without it it is not possible to use the benefits and rights associated with the participation of a member of the Loyalty Program of the EXIsport network. We will use personal data to the necessary extent given the purpose for which they will be processed.

Personal data processed for the purposes of operating the Loyalty Program are name, surname, address, street, house number, zip code, city, e-mail address, telephone number, signature (for a printed form), customer/loyalty card number (if assigned or assigned ), or other data required according to the Registration Form for the Loyalty Program. Only common and not special categories of personal data are processed. Personal data are intended for processing for the purpose of providing benefits and information associated with membership in the Loyalty Program, including the preservation of rights and benefits from the Original Operator's Loyalty Program, for generating the member's loyalty card, for addressing special offers/benefits to the member, for sending newsletters and for implementation marketing . Personal data may be combined with data on purchases and services used in the EXIsport network so that you are informed about the status of benefits and advantages arising from the Loyalty Program.

Your personal data will be stored for the duration of your membership in the Loyalty Program, unless legal regulations require a different storage period for some personal data.

These personal data may be provided to persons and recipients who participate in the operation of the Loyalty Program and the fulfillment of the stated purpose of personal data processing. Such persons are mainly contractual partners of the Company as the operator of the Loyalty Program and the EXIsport network, such as postal companies, courier companies, insurance companies, persons from the field of information technology and consultancy, through which communication with program members, operation, support, evaluation is ensured  and maintenance of the Loyalty Program, offer of special benefits, discounts, services.

As the operator of personal data processing for the stated purpose and the operator of the Loyalty Program we present our identification and contact details:

Our valid contact details can be found at www.exisport.com in the Personal Data Protection section, as well as the contact details for any person responsible for personal data protection.

According to the Regulation, you (the person concerned) have the right to:

a)    revoke the consent granted at any time, without this having any effect on the legality of the processing based on the consent granted before its revocation;

b)    request from the Company access to personal data concerning the person concerned and for their correction or deletion or restriction of processing,

c)    to object to the processing of personal data,

d)    on the portability of personal data,

e)    be informed about the source from which the personal data come, or information about whether they come from publicly accessible sources, if the personal data were not obtained from you,

f)     file a complaint with the supervisory authority at the Office for the Protection of Personal Data with headquarters in Bratislava.

These rights correspond to our obligations. Each of your authorizations according to letter a) to f) can be applied by sending a request to the Company's headquarters, by sending an e-mail to the address obseneudaje@ppggroup.eu , by delivering the request to any of the EXIsport network stores, depending on which of these forms is the most accessible to you. Your request should indicate which of these rights and how you want to use them.

We are obliged to provide you with information about a different purpose and other relevant information according to the mentioned legal regulations, if we intend to further process personal data for a purpose other than the one for which they were obtained . If that is the intention, we will inform you about it.  We do not perform automated individual decision-making or profiling according to the Regulation and the aforementioned law, we will notify you of any changes. However, the company may send notifications about special opportunities and benefits applicable to the region to affected persons from the same region.

The participation of persons in the Loyalty Program requires consent to the terms of this program and consent to the provision and processing of personal data. Personal data for the registration of those interested in membership in the Loyalty Program or for making changes to already existing members can be provided and filled in by these persons in particular in the EXIsport Registration Form on the www.exisport.com website (when available) or on a printed form at any store in the network EXIsport or in the form of the relevant third-party electronic application (if available). The personal data provided must be true, up-to-date, and please notify us of any changes. In connection with the offer of information society services, we can introduce measures to verify whether the consent of the person concerned, who is under 16 years old, is provided or approved by his legal representative, or proceed according to the legal regulations in this area. By providing personal data, signing and expressing consent in the part of the granted consent to the processing of personal data for the Loyalty Program for new applicants for membership from the indicated date, the Company is granted consent to the processing of personal data according to these conditions.
