(hereinafter referred to as the "Statute")

 

The Statute regulates the conditions of participation in the competition, the method and procedure for carrying out the activities necessary for its implementation and defines the details of the rights and obligations of the participants.

  1.       Contest organizer (hereinafter referred to as "Organizer")

2. Date of the competition

The competition will take place between February 9, 2024 and February 22, 2024 . It is possible to register for the competition during this period.

3. Persons authorized to participate in the competition

Only natural persons older than 18 years of age with a delivery address in the territory of the Slovak Republic who are registered on the social network FACEBOOK (www.facebook.com) or on INSTAGRAM (www.instagram.com) can participate in the competition , have for the entire duration of the competition active their FACEBOOK account or INSTAGRAM account and fulfill the specified rules of the competition (hereinafter referred to as "contestants"). Contestants undertake to comply with all the rules for using the FACEBOOK network listed at www.facebook.com/terms.php and also undertake to comply with all the rules of INSTAGRAM (in the case of linking the competition on both social platforms). The voter has an active FACEBOOK account (or an active INSTAGRAM account) for the entire duration of the contest.

 

4. Conditions of participation in the competition:

In order to participate in the competition, the authorized participant of the competition is required to fulfill the following conditions:

4.a) older than 18 years, who has a permanent residence in the territory of the Slovak Republic

4.b) purchases goods at the e-shop www.exisport.com with a minimum value of €70 including VAT in the period from 02/09/2024 from 00:00:01 to 02/22/2024 to 23:59:59

4. c) chooses the type of DPD transport on the territory of the Slovak Republic

 

Other conditions of the competition

The organizer of the competition is entitled to change the rules of the competition unilaterally without compensation during its duration, to shorten, postpone, interrupt or completely cancel the promotion.

Participation in the competition or winnings cannot be legally enforced or alternatively paid in money.

Possible objections to the course of the competition can be sent to the organizer in writing to the postal address specified in these rules within 3 working days from the end of the competition. Objections submitted later will not be taken into account.

Persons who do not meet the conditions for participation in the competition or who act in violation of the rules will not be included in the competition. If it turns out that this person has become a winner despite the above, for example due to duplication of FACEBOOK accounts (or INSTAGRAM accounts), he is not entitled to win.

The organizer reserves the right, without giving a reason, to exclude a participant whose behavior or FACEBOOK (INSTAGRAM) profile shows signs of unfair or fraudulent behavior (eg: duplicate FACEBOOK accounts or INSTAGRAM account).

Furthermore, the organizer reserves the right to exclude a participant of the competition whose behavior or FACEBOOK (INSTAGRAM) profile contradicts the rules of the FACEBOOK (INSTAGRAM) social network. If this violation is detected or suspected, such account will be reported as fraudulent and the release of the prize will be suspended until an administrator or responsible employee of FACEBOOK (INSTAGRAM) is notified.

The organizer of the competition is not responsible for any technical problems in connection with participation in the event (mainly the functionality of the FACEBOOK or INSTAGRAM network). Furthermore, the organizer is not responsible for the delivery of the message, which will be used to send the information about the prize, and for the delivery of the prize sent by the postal service provider.

All employees of the intermediary and organizer of the competition, their close associates and other cooperating legal and natural persons participating in this competition, including their employees and persons close to them and their employees, are excluded from the competition. In the event that any of these persons becomes a winner, they cannot receive the prize, which will be forfeited to the organizer of the competition.

 

5. Winning

The tax liability for the prize is borne by the contest organizer.

 

6. Determination of the winner and notification of the win

After the deadline for registering for the competition, the winner will be drawn from among validly registered participants by generating orders from the e-shop www.exisport.com from 9/2/2024 from 00:00:01 to 22/02/2024 to 23:59:59 who used only the DPD carrier.

The announcement of the winner of the competition will be published on the Facebook or Instagram page of EXIsport ( PPG Group s.r.o.) , on the following links:

The winner will also be directly contacted by the Organizer on the contacts provided by him. If the winner does not respond to the notification of the prize within 14 days and does not express an interest in claiming the prize, he loses the right to the prize. In that case, the organizer will repeat the draw.

7. Method of prize delivery

The winner and the Organizer will agree on the method of handing over the prize. If no mutual agreement is reached, the prize will be sent by mail to the winner at the Organizer's expense.

8. Protection of personal data

Declaration on the processing of personal data

The organizer of the competition PPG Group s.r.o., Opatovská cesta 14, 040 01 Košice, ID number: 51887819 (hereinafter referred to as the "Organizer") processes personal data in order to provide high-level services, including more efficient use of the organizer's client service, fulfillment of legal obligations and provision of information about news , including various benefits. The personal data of the contestant is processed by the organizer only on the basis of the legal conditions specified in the Regulation [1] or the Act [2] on the protection of personal data. The goal of the organizer is the effective protection of the competitor's personal data and a transparent procedure for providing information.

1. Principles of personal data protection

The organizer has a legal obligation to provide the competitor's personal data during inspection, surveillance activities or at the request of authorized state authorities or institutions, if this results from special regulations [3].

The contestant's personal data will be stored securely, in accordance with the organizer's and intermediary's security policy, and only for the time necessary to fulfill the purpose of the processing. Access to the contestant's personal data will be granted exclusively to persons authorized by the organizer to process personal data, who process them based on the organizer's instructions, in accordance with the organizer's security policy.

The contestant's personal data is backed up in accordance with the organizer's retention rules. The competitor's personal data will be completely deleted from backup storage as soon as possible in accordance with the backup rules. Personal data stored on backup storages serves to prevent security incidents, in particular disruption of data availability as a result of a security incident. The organizer is obliged to ensure data backup in accordance with the security requirements of the Regulation and the Personal Data Protection Act.

When processing personal data by the organizer, the competitor is the affected person, i.e. the person about whom personal data relating to him/her are processed.

In accordance with the Regulation and the Personal Data Protection Act, the organizer processes personal data of the contestant to the extent and under the conditions established in special regulations. The personal data of the competitor is processed by the organizer on the basis of the legal conditions specified in Art. 6 Regulations.

Purposes of processing your personal data

Organizing competitions

In order to support the sale of goods, the organizer processes personal data of the contestant based on the consent of the person concerned by organizing various competitions through the social network Facebook and Instagram. For the stated purpose, the operator processes the following personal data: data listed in the competitor's profile and, in the case of the winner, his name, surname, telephone number, address and photo with the prize.

The organizer may also process the contestant's personal data for the purposes of providing electronic communication services or payment transactions (on the basis of special laws governing payment transactions); data exchange between operators of electronic communications services that ensure access to telecommunications networks (processing takes place on the basis of the Telecommunications Act), operation of information systems (purpose of taking measures for network security, based on the legitimate interest of the organizer).

In very specific cases, the organizer may process the contestant's personal data in order to exercise legal claims.

The contestant's personal data will be processed for the duration of the contest and 10 years after its end, in accordance with the requirements of special regulations governing tax obligations. The personal data of the contestant is also processed by the organizer for the purpose of fulfilling the company's obligations according to special regulations, in particular according to Act no. 395/2002 Coll. on archives and registries and on amendments to certain laws.

2. Contestant's rights according to the regulation and the Personal Data Protection Act

Right of access

The competitor has the right to provide a copy of the personal data that the organizer has about him, as well as to information about how his personal data is used.

In most cases, the competitor's personal data is provided in written document form, unless he requests another way of providing them. If the competitor requests the provision of this information by electronic means, it will be provided electronically if it is technically possible.

Right to rectification

The organizer takes reasonable measures to ensure the accuracy, completeness and timeliness of the information it has about the contestant. If the competitor has the impression that the data held by the organizer is inaccurate, incomplete or out of date, he should not hesitate to ask the organizer to correct, update or supplement this information.

Right to erasure

The competitor has the right to ask the organizer to delete his personal data, for example, if the personal data that the organizer obtained about the competitor is no longer necessary to fulfill the original purpose of processing. However, the competitor's right must be assessed from the perspective of all relevant circumstances. For example, the organizer may have certain legal and regulatory obligations, which means that it will not be able to comply with the contestant's request.

 

Right to restriction of processing

Under certain circumstances, the competitor is entitled to ask the organizer to stop using his personal data. These are, for example, cases when the competitor believes that his personal data, which the organizer has, may be inaccurate or that he no longer needs to use them.

Right to data portability

Under certain circumstances, the contestant has the right to request the organizer to transfer personal data provided by the contestant to another third party of the contestant's choice. However, the right to portability only applies to personal data that the organizer has obtained on the basis of consent or on the basis of a contract to which the competitor is one of the contracting parties.

The right to object

The competitor has the right to object to the processing of data, which is based on the legitimate legitimate interests of the organizer. In the event that the organizer does not have a convincing, legitimate reason for processing and the contestant files an objection, the organizer will not further process the contestant's personal data.

The right to file a complaint

If the competitor wants to file a complaint about the way his personal data is processed, including the exercise of the above-mentioned rights, he can contact our responsible person. All suggestions and complaints will be properly checked by the organizer.

If the competitor is not satisfied with the answer of the organizer, or believes that his personal data is processed unfairly or illegally, he can file a complaint with the supervisory authority, which is the Personal Data Protection Office of the Slovak Republic, https://dataprotection.gov.sk . If it turns out that this person has become a winner despite the above, for example due to duplication of FACEBOOK accounts (or INSTAGRAM accounts), he is not entitled to win.

The organizer reserves the right, without giving a reason, to exclude a participant whose behavior or FACEBOOK (INSTAGRAM) profile shows signs of unfair or fraudulent behavior (eg: duplicate FACEBOOK accounts or INSTAGRAM account).

Furthermore, the organizer reserves the right to exclude a participant of the competition whose behavior or FACEBOOK (INSTAGRAM) profile contradicts the rules of the FACEBOOK (INSTAGRAM) social network. If this violation is detected or suspected, such account will be reported as fraudulent and the release of the prize will be suspended until an administrator or responsible employee of FACEBOOK (INSTAGRAM) is notified.

The organizer of the competition is not responsible for any technical problems in connection with participation in the event (mainly the functionality of the FACEBOOK or INSTAGRAM network). Furthermore, the organizer is not responsible for the delivery of the message, which will be used to send the information about the prize, and for the delivery of the prize sent by the postal service provider.

All employees of the intermediary and organizer of the competition, their close associates and other cooperating legal and natural persons participating in this competition, including their employees and persons close to them and their employees, are excluded from the competition. In the event that any of these persons becomes a winner, they cannot receive the prize, which will be forfeited to the organizer of the competition.

5. Winning

The tax liability for the prize is borne by the contest organizer.

6. Determination of the winner and notification of the win

After the deadline for registering for the competition, the winner will be drawn from among validly registered participants for the period from February 15 , 2024, from 00:00:01 to March 15, 2024, to 23:59:59.

The announcement of the winner of the competition will be published on the Facebook or Instagram page of EXIsport (PPG Group s.r.o.) , on the following links:

The winner will also be directly contacted by the Organizer on the contacts provided by him. If the winner does not respond to the notification of the prize within 14 days and does not express an interest in claiming the prize, he loses the right to the prize. In that case, the organizer will repeat the draw.

7. Method of prize delivery

The winner and the Organizer will agree on the method of handing over the prize. If no mutual agreement is reached, the prize will be sent by mail to the winner at the Organizer's expense.

8. Protection of personal data

Declaration on the processing of personal data

The organizer of the competition PPG Group s.r.o., Opatovská cesta 14, 040 01 Košice, ID number: 51887819 (hereinafter referred to as the "Organizer") processes personal data in order to provide high-level services, including more efficient use of the organizer's client service, fulfillment of legal obligations and provision of information about news , including various benefits. The personal data of the contestant is processed by the organizer only on the basis of the legal conditions specified in the Regulation [1] or the Act [2] on the protection of personal data. The goal of the organizer is the effective protection of personal data of the contestant and a transparent procedure for providing information.

1. Principles of personal data protection

The organizer has a legal obligation to provide the competitor's personal data during inspection, surveillance activities or at the request of authorized state authorities or institutions, if this results from special regulations [3].

The contestant's personal data will be stored securely, in accordance with the organizer's and intermediary's security policy, and only for the time necessary to fulfill the purpose of the processing. Only persons authorized by the organizer to process personal data, who process them based on the instructions of the organizer, in accordance with the organizer's security policy, will have access to the contestant's personal data.

The contestant's personal data is backed up in accordance with the organizer's retention rules. The contestant's personal data will be completely deleted from backup storage as soon as possible in accordance with the backup rules. Personal data stored on backup storages serves to prevent security incidents, in particular disruption of data availability as a result of a security incident. The organizer is obliged to ensure data backup in accordance with the security requirements of the Regulation and the Personal Data Protection Act.

When processing personal data by the organizer, the competitor is the affected person, i.e. the person about whom personal data relating to him/her are processed.

In accordance with the Regulation and the Personal Data Protection Act, the organizer processes personal data of the contestant to the extent and under the conditions established in special regulations. The personal data of the competitor is processed by the organizer on the basis of the legal conditions specified in Art. 6 Regulations.

Purposes of processing your personal data

Organizing competitions

In order to support the sale of goods, the organizer processes personal data of the contestant based on the consent of the person concerned by organizing various competitions through the social network Facebook and Instagram. For the stated purpose, the operator processes the following personal data: data listed in the competitor's profile and, in the case of the winner, his name, surname, telephone number, address and photo with the prize.

The organizer may also process the contestant's personal data for the purposes of providing electronic communication services or payment transactions (on the basis of special laws governing payment transactions); data exchange between operators of electronic communications services that ensure access to telecommunications networks (processing takes place on the basis of the Telecommunications Act), operation of information systems (purpose of taking measures for network security, based on the legitimate interest of the organizer).

In very specific cases, the organizer may process the contestant's personal data in order to exercise legal claims.

The contestant's personal data will be processed for the duration of the contest and 10 years after its end, in accordance with the requirements of special regulations governing tax obligations. The personal data of the contestant is also processed by the organizer for the purpose of fulfilling the company's obligations according to special regulations, in particular according to Act no. 395/2002 Coll. on archives and registries and on amendments to certain laws.

2. Contestant's rights according to the regulation and the Personal Data Protection Act

Right of access

The competitor has the right to provide a copy of the personal data that the organizer has about him, as well as to information about how his personal data is used.

In most cases, the competitor's personal data is provided in written document form, unless he requests another way of providing them. If the competitor requests the provision of this information by electronic means, it will be provided electronically if it is technically possible.

Right to rectification

The organizer takes reasonable measures to ensure the accuracy, completeness and timeliness of the information it has about the contestant. If the competitor has the impression that the data held by the organizer is inaccurate, incomplete or out of date, he should not hesitate to ask the organizer to correct, update or complete this information.

Right to erasure

The competitor has the right to ask the organizer to delete his personal data, for example, if the personal data that the organizer obtained about the competitor is no longer necessary to fulfill the original purpose of processing. However, the competitor's right must be assessed from the perspective of all relevant circumstances. For example, the organizer may have certain legal and regulatory obligations, which means that it will not be able to comply with the contestant's request.

 

Right to restriction of processing

Under certain circumstances, the competitor is entitled to ask the organizer to stop using his personal data. These are, for example, cases when the competitor believes that his personal data, which the organizer has, may be inaccurate or that he no longer needs to use them.

Right to data portability

Under certain circumstances, the contestant has the right to request the organizer to transfer personal data provided by the contestant to another third party of the contestant's choice. However, the right to portability only applies to personal data that the organizer has obtained on the basis of consent or on the basis of a contract to which the competitor is one of the contracting parties.

The right to object

The competitor has the right to object to the processing of data, which is based on the legitimate legitimate interests of the organizer. In the event that the organizer does not have a convincing, legitimate reason for processing and the contestant files an objection, the organizer will not further process the contestant's personal data.

The right to file a complaint

If the competitor wants to file a complaint about the way his personal data is processed, including the exercise of the above-mentioned rights, he can contact our responsible person. All suggestions and complaints will be properly checked by the organizer.

If the competitor is not satisfied with the answer of the organizer, or believes that his personal data is processed unfairly or illegally, he can file a complaint with the supervisory authority, which is the Personal Data Protection Office of the Slovak Republic, https://dataprotection.gov.sk . 9. Final Provisions

By participating in the competition, each contestant also confirms that they are aware that Facebook and Instagram have no obligations towards the contestant and that no such obligations arise from participating in the Facebook and Instagram Competition.

The Contest Promoter declares that the Contest is in no way sponsored, endorsed, administered by, or otherwise associated with Facebook and Instagram and is not otherwise associated with Facebook and Instagram.
